Barkatealliance Code of Conduct

Barkatealliance welcomes every user: Whether organizations or individuals, whether streamers or viewers, we strive to provide users with the best streaming and viewing environment; and hope to work hand-in-hand with users for common progress, painting a brighter future.

In response to relevant content in the latest "Measures for the Management of Credit Information of Seriously Dishonest Entities in Internet Information Services (Draft for Comment)" issued by the Cyberspace Administration of China, to create a harmonious and healthy online environment, and better protect users' legitimate rights and interests and good user experience, Barkatealliance has formulated this "Barkatealliance User Code of Conduct" (hereinafter referred to as "this Code") based on existing laws and regulations, the "Barkatealliance User Registration Agreement", the "Barkatealliance User Positive Behavior Guidelines", and other Barkatealliance platform rules.

Chapter 1 General Provisions

Article 1 Barkatealliance respects the legitimate rights and interests of every user and will treat all users equally in accordance with open and transparent standards.

Article 2 Users shall comply with the laws and regulations of their region and respect the moral and customs of their region when using Barkatealliance platform services. If a user's behavior violates local laws, regulations, or moral customs, the user shall bear independent responsibility for this.

Article 3 All user behaviors on the Barkatealliance platform, including but not limited to bullet chats, posting, reposting, replying, leaving messages, and station messages, shall comply with this Code and other Barkatealliance platform rules. Where both this Code and the original rules stipulate, this Code shall prevail; matters not covered by this Code shall be governed by the original rules.

Article 4 If user behavior violates relevant laws, regulations, and the provisions of this Code, the Barkatealliance platform will take reasonable handling measures against the违规 behavior in accordance with relevant laws, regulations, and this Code, and cooperate with judicial authorities to protect the legitimate rights and interests of Barkatealliance users and other entities.

For any behavior suspected of violating national laws, administrative regulations, departmental rules, and other normative documents, for which this Code and other Barkatealliance platform rules have no provisions, the Barkatealliance platform will handle it at its discretion.

Article 5 If users have any doubts or disputes regarding the understanding and implementation of this Code, they can inform Barkatealliance platform customer service, and the Barkatealliance platform will provide explanations or handle them according to relevant rules.

Chapter 2 Rules for Handling Violations

Article 6 If the Barkatealliance platform discovers or receives reports or complaints that a user violates the terms of this Code, the Barkatealliance platform has the right to independently judge the user's behavior, directly delete or block违规 content, and impose penalties such as warnings, banning from speaking (including banning the违规 account and its associated accounts from speaking in live streams and forums), temporary or permanent suspension of the违规 account and its associated accounts, etc., based on the severity of the circumstances, and has the right to announce the handling results.

Based on the severity of the circumstances, the penalty measures are divided into:

• Level 1 Penalty: Warning

• Level 2 Penalty: Ban from speaking

• Level 3 Penalty: Account suspension for 1 to 30 days (excluding 30 days)

• Level 4 Penalty: Account suspension for 30 to 360 days

• Level 5 Penalty: Permanent account suspension and refusal to provide any further services to the user

If a user receives a Level 1-4 penalty due to违规 behavior, and during the penalty period promptly contacts the Barkatealliance platform for communication, effectively reduces the negative impact caused by the违规 behavior, and promises to strictly use the platform services legally and reasonably in accordance with platform rules, the Barkatealliance platform may reduce the penalty imposed on the user based on the circumstances.

Article 7 During the ban from speaking period, users will be unable to use the comment services provided by the Barkatealliance platform for registered users, including but not limited to live streaming, bullet chats, posting, reposting, replying, leaving messages, station messages, etc.

Article 8 During the account suspension period, users will be unable to use all services provided by the Barkatealliance platform for registered users. Virtual gifts, virtual items, and virtual services in the account will be unusable. If the aforementioned virtual gifts, virtual items, and virtual services have a certain validity period, this validity period may expire during the suspension period. After the account is unsuspended, users will be unable to use such expired virtual gifts, virtual items, and virtual services, and users cannot hold the platform legally responsible for this.

Article 9 Barkatealliance's handling of违规 behavior does not exempt the user from their legal responsibilities. The Barkatealliance platform has the right to initiate corresponding civil lawsuits against the user's illegal or违规 behavior, pursue the user's liability for infringement, breach of contract, or other civil liabilities, and demand compensation from the user for losses suffered by the Barkatealliance platform due to the illegal or违规 behavior (including direct economic losses suffered by the Barkatealliance platform, reputational or goodwill losses, and compensation paid by the Barkatealliance platform to external parties, settlement costs, legal fees, litigation costs, and other indirect losses), or transfer the case to relevant administrative authorities for administrative penalties, or transfer the case to judicial authorities to investigate the user's criminal liability.

Article 10 The Barkatealliance platform will make judgments to the best of its ability within its capacity in accordance with effective laws and regulations, but does not guarantee that its judgments are completely consistent with those of judicial or administrative authorities.

Chapter 3 User Behavior Standards

Article 11 User Barkatealliance account avatars, nicknames, profile signatures, and other registration information and authentication materials, as well as all text, images, videos, and audio uploaded, published, or transmitted by users on the Barkatealliance platform, must not contain content that violates national laws, regulations, policies, and social public order and good customs, endangers national and social public interests, infringes upon the legitimate rights and interests of third parties, or interferes with the normal operation of the Barkatealliance platform.

Article 12 If a user's behavior or published information on the Barkatealliance platform contains the following content, it will be deemed a serious violation. The Barkatealliance platform has the right to directly delete or block the违规 content and simultaneously impose a Level 5 penalty.

• (I) Violating or opposing the basic principles established by the Constitution;

• (II) Endangering national security, leaking state secrets, subverting state power, or undermining national unity;

• (III) Harming national honor and interests;

• (IV) Inciting ethnic hatred, ethnic discrimination, or undermining ethnic unity;

• (V) Undermining national religious policies, promoting cults and feudal superstitions;

• (VI) Spreading rumors, disturbing social order, or undermining social stability;

• (VII) Inciting illegal assemblies, forming organizations, processions, demonstrations, or gathering to disrupt social order;

• (VIII) Distorting, vilifying, desecrating, or denying the deeds and spirit of heroes and martyrs;

• (IX) Insulting, defaming, or otherwise infringing upon the names, portraits, reputations, or honors of national leaders, heroes, and martyrs;

• (X) Directly or indirectly disseminating obscene, pornographic content or sexual innuendo, including but not limited to:

1. Depicting or describing sexual behavior, exposing or describing human sexual organs or private parts;

2. Publishing content with sexual innuendo or sexual teasing;

3. Publishing pornographic and vulgar novels, pornographic audio-visual content, pornographic playback links, and pornographic platform locations;

4. Publishing information about improper social interactions such as nude chats, one-night stands, wife-swapping, S&M, or transactions for sexual services;

5. Other obscene, pornographic content or sexual innuendo.

• (XI) Promoting violence, murder, bloodshed, terror, organized crime, or inciting crime, including but not limited to:

1. Disseminating content involving self-harm, mutilation, suicide, homicide, shootings, stabbings, torture, etc., that causes discomfort;

2. Disseminating content that induces others to self-harm, mutilate, commit suicide, or teaches/instigates others to commit crimes;

3. Disseminating footage of drug or controlled substance abuse that causes discomfort;

4. Disseminating content about selling simulated guns, bows and arrows, controlled knives, air guns, and other lethal weapons;

5. Disseminating descriptions of real weapons for the purpose of encouraging illegal or improper use;

6. Disseminating information related to revenge or debt collection, which has the nature of organized crime;

7. Recruiting, inducing, or teaching others to engage in terrorist or violent activities;

8. Other content promoting violence, murder, bloodshed, terror, organized crime, or inciting crime.

• (XII) Spreading false or fraudulent information to deceive others for information or property, including but not limited to:

1. Deceiving others of money through false brush ordering (fake reviews), false part-time job recruitment information, ticket information, winning prize information, phishing websites, etc.;

2. Obtaining others' personal information by impersonating relatives/friends or in the name of organizing activities;

3. Organizing, promoting, or inducing users to join pyramid schemes (or suspected pyramid schemes) or other illegal organizations;

• (XIII) Publishing content that coerces or induces others to participate in gambling, introduces or teaches gambling techniques/methods, sells gambling devices, or otherwise promotes gambling;

• (XIV) Money laundering behavior within the platform, using various means to conceal or hide the source and nature of funds derived from crime or other illegal所得 and their proceeds, making them appear legal in form;

• (XV) Disseminating content involving the sale of illegal items such as fake invoices, counterfeit cigarettes, counterfeit currency, stolen goods, smuggled goods, ivory or tiger bone and other wildlife products, drugs, wiretapping devices, arms, human organs, date rape drugs, state secrets, etc.;

• (XVI) Disseminating content about illegal document processing/seal engraving,代办 ID cards, passports, Hong Kong and Macau permits, marriage certificates, household registers, academic degree certificates, and other documents;

• (XVII) Disseminating content about illegal credit card processing, credit card cash-outs, housing fund cash-outs, health insurance card cash-outs, mobile phone clone cards, etc.;

• (XVIII) Other content restricted or prohibited by laws and administrative regulations.

Article 13 If a user publishes content on the Barkatealliance platform that infringes upon the legitimate rights and interests of a third party, the Barkatealliance platform has the right to directly delete or block the违规 content and simultaneously impose a Level 2, 3, or 4 penalty depending on the severity of the circumstances.

If a user continuously or extensively publishes content that infringes upon the legitimate rights and interests of third parties, or violates the rules again after receiving a handling notice from the Barkatealliance platform, it will be deemed a serious violation, and the Barkatealliance platform has the right to impose a Level 5 penalty.

• (I) Swearing, insulting, defaming, harassing, discriminating against, or threatening others;

• (II) Investigating, probing, or disclosing others' personal information such as name, photos, private life footage, ID card number (or passport number), bank account number, online account, phone number, address, email address, financial status, family background, social relationships, employer/job information, school/education information, medical records, sexual orientation, criminal record, etc.;

• (III) Disseminating content that infringes upon others' copyright, trademark rights, patent rights, and other intellectual property rights;

• (IV) Illegally disclosing others' trade secrets;

• (V) Unauthorized use of others' names or portraits, infringing upon their right to name, portrait rights, and other legitimate rights and interests;

• (VI) Unauthorized use of registered business names or trademarks of others, infringing upon their business name rights or trademark exclusive rights;

• (VII) Stealing others' identity information or accounts, explicitly or implicitly implying equivalence or association with others;

• (VIII) Other content that infringes upon others' legitimate rights and interests such as reputation rights, privacy rights, name rights, rights to name, honor rights, portrait rights, trade secrets, intellectual property rights, etc.

Article 14 If a user engages in the following activities that interfere with the normal operation of the Barkatealliance platform on the Barkatealliance platform or other third-party platforms, the Barkatealliance platform has the right to directly delete or block the违规 content and simultaneously impose a Level 2, 3, or 4 penalty depending on the severity of the circumstances.

If a user continuously or seriously interferes with the normal operation of the Barkatealliance platform, or violates the rules again after receiving a handling notice from the Barkatealliance platform, it will be deemed a serious violation, and the Barkatealliance platform has the right to impose a Level 5 penalty.

• (I) Provoking and inciting others' emotions, attacking, mocking, discriminating against, or isolating third parties, instigating conflicts or engaging in group disputes or verbal wars with other groups;

• (II) Insulting, disparaging, harassing, or impersonating Barkatealliance streamers, Barkatealliance users, Barkatealliance platform staff, or the Barkatealliance platform itself;

• (III) Promoting or inducing users to go to other live streaming platforms;

• (IV) Maliciously spamming using special characters, symbols, etc., seriously affecting the user experience of others;

• (V) Spreading viruses, files, computer code, or programs that may damage or interrupt the normal operation of the Barkatealliance platform;

• (VI) Using or utilizing Barkatealliance's intellectual property (including Barkatealliance's trademarks, brands, logos, any other proprietary data, or the layout or design of any web page), or otherwise infringing upon any of Barkatealliance's intellectual property rights (including attempting to reverse engineer the Barkatealliance platform client or the software used);

• (VII) Using Barkatealliance platform services for any commercial purpose or for the benefit of any third party without the explicit permission of Barkatealliance;

• (VIII) Accessing Barkatealliance platform services, collecting, or processing content provided through Barkatealliance platform services by using any automated programs, software, engines, web crawlers, web analytics tools, data mining tools, or similar tools;

• (IX) Participating in any "framing," "mirroring," or other techniques aimed at imitating the appearance and function of Barkatealliance platform services;

• (X) Interfering or attempting to interfere with any user's or any other party's access to Barkatealliance platform services;

• (XI) Probing or testing whether Barkatealliance platform services, systems, or other users' systems are vulnerable to intrusion attacks, or otherwise circumventing (or attempting to circumvent) any security functions of Barkatealliance platform services, systems, or other users' systems;

• (XII) Disassembling, reverse compiling, or reverse engineering the software used for Barkatealliance platform services, or attempting to do so;

• (XIII) Opening multiple accounts for the purpose of destruction or abuse, or maliciously uploading duplicate, invalid large-volume data and information;

• (XIV) Performing any behavior that undermines the fairness of Barkatealliance platform services or otherwise affects the normal order of the application, such as active or passive score brushing, collusion, using plug-ins or other cheating software, using BUGs (also known as "vulnerabilities" or "defects") to obtain improper illegal benefits, or using the internet or other methods to make plug-ins, cheating software, and BUGs public;

• (XV) Conducting any commercial activities such as posting advertisements and selling goods, or conducting any illegal activities that infringe upon the interests of the Barkatealliance platform, such as selling Barkatealliance platform accounts, virtual products like virtual currency, noble membership value-added services, fan badges, plug-ins, etc.;

• (XVI) Maliciously reporting live streams or other individuals;

• (XVII) Other behaviors that interfere with Barkatealliance platform order or infringe upon Barkatealliance platform interests.

Article 15 If a user engages in the following activities on the Barkatealliance platform that violate social public order and good customs, the Barkatealliance platform has the right to directly delete or block the违规 content and simultaneously impose a Level 1 and/or Level 2 penalty depending on the severity of the circumstances.

If the user's behavior causes serious impact, resulting in the Barkatealliance platform being involved in a public incident, the Barkatealliance platform has the right to impose a Level 3, 4, or 5 penalty.

• (I) Uncivilized behaviors such as using coarse language, telling dirty jokes, etc.;

• (II) Promoting inappropriate consumption and values such as flaunting wealth or worshiping money;

• (III) Promoting bad lifestyle habits such as smoking, excessive drinking, extramarital affairs, etc.;

• (IV) Other content that violates social public order and good customs.

Article 16 If a user engages in other behaviors that violate laws, regulations, and Barkatealliance platform rules not specified in Articles 12 to 15 of this Code, Barkatealliance will handle them according to specific rules if they exist. If no specific handling rules exist, the Barkatealliance platform will handle them at its discretion based on the severity of the circumstances, taking one or more handling measures such as deleting/blocking content, warnings, banning from speaking (including banning from speaking in live streams and forums), temporary or permanent account suspension, etc., and has the right to announce the handling results.

Chapter 4 Supplementary Provisions

Article 17 This Code is a dynamic document. The Barkatealliance platform has the right to modify the content of this Code based on relevant laws and regulations or product operational needs and will publicize such modifications.

Article 18 This Code takes effect and is implemented from the date of publication and applies to all users of the Barkatealliance platform. User use of Barkatealliance platform services is deemed acceptance of this Code, which is legally binding on the user.

Article 19 This Code is an integral part of the "Barkatealliance User Registration Agreement". Matters not covered in this Code shall be governed by the relevant provisions of the "User Registration Agreement".
